Areas of Practice

Criminal Defense

Being charged with a crime is a serious matter.  We work hard to ensure that our clients understand the legal process, from arraignment on, and try to provide the best universe of options while fighting to protect your rights.

Freedom for FREDERICK BURTON

Since Jonathan was a child he has been working to obtain freedom from a lifetime of incarceration for Frederick Burton.  Mr. Burton was wrongfully convicted of murder in 1972 and has been incarcerated for over 40 years.  Please read more about Mr. Burton's case here.

APPEALS AND WRITS

If you're a litigant who wished to appeal a matter or an attorney who wants the assistance of experience appellate or law and motions attorneys, then we can help you.  Our lawyers have extensive appellate and law and motions practice for both litigants and attorneys who seek special project assistance.

Police Abuse & Excessive Force

If you have suffered an injury at the hands of the police, then you may have a claim against the officer and the law enforcement agency.  This type of litigation, commonly known as "1983" or violation of civil rights, is incredibly complex and requires the diligence of an experienced practitioner as well as the resolve of a determined advocate.  Elizabeth and Jonathan believe that this type of litigation not only helps litigants achieve a sense of justice after their rights have been violated but has the broader power to impact departments to change unconstitutional policies and practices.  We are passionate about protecting civil rights and preventing police abuse and excessive force.  Please read about our case of W.S. and L.S. v. County of Santa Cruz here.

Wage & Hour

Unfortunately, wage theft is a common problem along the central coast. If your employer has failed to pay you on time, or failed to pay overtime or has misclassified you and reduced your wages, you may be entitled to compensation and penalties.

DISCRIMINATION AND HARASSMENT

If you have ever suffered discrimination or been harassed because of your sex, sexual orientation, race, religion or ethnicity, you may have a claim against the party responsible for the conduct.  The world of plaintiffs' civil rights is complex and constantly changing.  Our practice seeks to ensure that your rights and claims are protected and pursued to the fullest extent of the law.

DISMISSALS AND RECORD CLEARANCE

If you have suffered a conviction or been arrested and you want to get your record "cleared," California law permits you to petition the court for "dismissals."  In addition, for the first time ever, you may be eligible to have your record sealed for an arrest or charge that did not result in a conviction.  We have extensive experience handling petitions of this nature and can help you navigate the often confusing area of law.
